Terms of service

1. Scope of Application

These Terms and Conditions apply to all orders placed through our online store by consumers and businesses.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. A business is a natural or legal person or a legally recognized partnership acting in the exercise of its commercial or professional activity.

For business customers: Any conflicting or additional terms and conditions shall not apply unless expressly agreed to by us in writing.

2. Contract Partner, Contract Formation, and Corrections

The purchase contract is concluded with Jan Rassa (PURE Studios).

Product listings in our online shop do not constitute a legally binding offer but an invitation to place an order. You may place items in your shopping cart without obligation and correct your entries at any time before submitting your order by using the correction tools provided during checkout.

By clicking the order button, you submit a binding offer to purchase the items in your cart. Confirmation of receipt of your order will be sent by email immediately after submission.

We accept your order within two days by:

  • sending an order confirmation email, or
  • dispatching the goods, or
  • processing the payment transaction through our payment provider or the selected payment service.

The contract is formed when the first of these actions occurs.

3. Contract Language and Storage

The contract language is German.

We store the contract text and send you the order details and these Terms and Conditions by email. For security reasons, the contract text is no longer accessible online.

4. Delivery Conditions

8. Transport Damage

For consumers:
If goods arrive with visible transport damage, please report this to the delivery service immediately and contact us. This does not affect your statutory warranty rights but helps us assert claims against the carrier.

For businesses:
Risk passes to the buyer once the goods are handed over to the carrier or shipping provider.

9. Warranty and Guarantees

9.1 Legal Warranty
Statutory warranty rights apply.

9.2 Guarantees and Customer Service

We are fully liable for damages caused by us or our agents in cases of:

  • injury to life, body, or health
  • intentional or grossly negligent misconduct
  • guarantee obligations
  • liability under the Product Liability Act

In the case of minor negligence affecting essential contractual obligations, liability is limited to foreseeable damages typical for the contract. All other claims for damages are excluded.

11. Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform, available online. We are not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.

12. Final Provisions

If you are a business customer, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
